Uber rape case: Police manufactured evidence against cab driver says defence counsel

Delhi Police has manufactured evidence against an Uber cab driver accused of raping a woman executive and there are several missing links in the investigation, the lawyer for the accused told a court here on Monday.

Accused Shiv Kumar Yadav's counsel, Dharmender Mishra told Additional Sessions Judge Kaveri Baweja that Delhi Police has planted several documents to implicate his client.

Advancing final arguments in the case, he said there were several improvements in the victim's statements and alleged that she had supported the shoddy and botched-up police probe.

Citing that the woman's statements before police while lodging first information report and before a magistrate had mentioned the name of the accused as "Gaurav" which she had come to know through mobile application Truecaller, he asked how could police know that the name of the accused was Shiv Kumar Yadav and proceed to arrest him.

He further added that the victim deliberately identified a wrong person as the accused in the case.

The arguments, which will continue on Tuesday, were resumed after the Supreme Court set aside the Delhi High Court order permitting the recall and re-examination of 13 witnesses including the victim in the rape case.

According to police, the woman executive was allegedly raped by Yadav on the night of December 5, 2014, in the cab she hired to head back home in north Delhi's Inderlok area. The accused drove the woman to an isolated place and allegedly raped her.

The court had on January 13 framed charges of rape, causing grievous bodily harm and endangering the life of a woman, besides other, against Yadav under various sections of the Indian Penal Code.
