
The News Minute | January 7, 2015 | 12.25 PM ISTThe High Court of Punjab and Haryana has said that jail inmates can have sex for the purpose of begetting a child. It linked the issue with the fundamental right of life and personal liberty under Article 21 of the Constitution. The court made these observations while hearing a case filed by a couple who were awarded death penalty for kidnapping and killing a boy and are currently serving sentence in the Central jail, Patiala. The plea was filed by the jailed couple asking permission to stay together for resuming their conjugal life for progeny. Justice Surya Kant passed an order asking the jail authorities to make necessary arrangements for jail inmates, but did not permit the said couple given the heinous nature of the crime they had committed, Times of India reported. The court also constituted a committee to study the matter further. It would formulate schemes for creation of systems for conjugal and family visits in jail and also the category of inmates who could be entitled to such visits."A society which is currently involved in academic and intellectual debates on 'gay-rights' or the recognition of 'third-gender', cannot shy away nor can it keep concealed under the carpet the pragmatic concept of conjugal visits of the jail inmates," the court observed. "To say it differently, time has come and before it is too late, the stake-holders must sit together and deliberate upon this crucial subject and take a holistic view," the court said.
