Karnataka HC rejects plea for extension of stay of three Pakistani minors

The mother of the three children, an Indian citizen, said that she was unable to leave through the Attari border, but her children were permitted to enter Pakistan.

The Karnataka High Court has rejected the visa extension plea of three children who are Pakistani nationals visiting India for a wedding. 

The vacation bench of the High Court, presided over by Justice MG Uma, rejected the plea filed by the children’s mother on May 8, saying that the court was not inclined to interfere with the Union government’s decision. 

The Union government had issued orders that all Pakistani nationals were to leave India by April 30 in the wake of the terror attack on Pahalgam. 

“The Union Government issued an order on 25-4-25 about the revocation of visas of Pakistan nationals. The Government has taken this conscious decision to safeguard the citizens of India. In this circumstance, I do not find any reason to interfere with the Government’s decision to pass a favourable order to the petitioner. Hence, the petition is dismissed,” the court said. 

The woman, an Indian citizen and resident of Mysuru, is married to a Pakistani man, Mohammed Farooq. She arrived in India on January 4 with their three children, aged eight, four and three years, who are Pakistani citizens. 

Ramsha said in the petition she filed on behalf of her children that they were visiting India to attend a wedding on May 12. She said that she attempted to leave the country via the Attari border and enter Pakistan, but she was unable to, as Pakistani authorities denied her entry into the country as she was an Indian citizen. The Pakistani authorities, however, had allowed her children to enter the country. 

She then returned to Mysuru and sought a visa extension with the Mysuru City Police on April 29. She approached the court after the city police rejected her application.
