Karnataka HC allows inspection of alleged illegal temple construction at Prestige Falcon City

The Karnataka High Court has directed the Bengaluru South Deputy Commissioner to inspect Prestige Falcon City after residents alleged that a temple was illegally constructed in the buffer zone of a stormwater drain.

The Karnataka High Court has permitted the Deputy Commissioner of Bengaluru South to inspect the premises of the Prestige Falcon City apartment complex in Konanakunte, following allegations of illegal construction of a temple within the buffer zone of a stormwater drain (rajakaluve).

The direction came on June 16 in response to a writ petition filed by residents opposing the alleged move by the Prestige Falcon City Apartment Owners’ Association to allow the temple’s construction. The petitioners said the site falls within the rajakaluve buffer zone, and the construction violates environmental and civic norms.

The High Court issued notices to the Apartment Owners’ Association, the Bruhat Bengaluru Mahanagara Palike (BBMP), and the Deputy Commissioner (Tahsildar) of Bengaluru South taluk. It also granted the DC authority to examine “the legality of construction stated to have been put up by respondent No. 1,” including the proposed temple work, as mentioned in the petition.

On April 18, 2025 the apartment owners’ association passed a resolution that allowed the temple construction. Some residents questioned the resolution’s validity and raised concerns over the collection of funds for the project.

The petitioners sought an immediate stay on the construction activities and the collection of funds, urging the High Court to direct the Bengaluru Urban district administration to probe what they have described as “illegal” construction within the designated buffer zone.
