Reports have emerged this morning that the Karnataka Pradesh Congress Committee’s Legal Cell has recommended to the Karnataka state government that the state not go ahead with an appeal against the Jayalalithaa DA case. The Karnataka High Court had recently acquitted Jayalalithaa in the case, which the state of Karnataka is prosecuting.According to the KPCC Legal Cell, the state of Karnataka is not an aggrieved party in the case and is only carrying out the Supreme Court's direction on transfer petition to try the case in Karnataka in an administrative capacity. KPCC says that since Karnataka has filed a petition earlier stating that they have no interest in the outcome of the case, appealing against the HC verdict now will amount to having interest, and that could be contempt of court. KPCC Legal Cell Press Release Karnataka Chief Minister K Siddaramaiah however told reporter this morning that no decision has been taken by the government yet, and that they are under no pressure from anybody.Sources in Public Prosecutor Acharya’s office have told The News Minute that they are not confident of a green signal for an appeal from the Karnataka government.If the Karnataka government decides not to go for an appeal against the HC verdict acquitting Jayalalithaa, what could be the political reasons behind it?One, the Rajya Sabha remains the crucial battleground between the BJP and Congress. If the Congress could curry a favour to Jayalalithaa, they could expect the AIADMK MPs in the Rajya Sabha to cooperate with the Congress party. This however might not play out well for Congress as the BJP too is believed to be going soft on Jaya, and as Subramanian Swamy says, it’s a political decision.Second, 2016 is election year in Tamil Nadu. Congress is scrapping the bottom of the barrel in Tamil Nadu and hoping for a face-saving performance. AIADMK sources say that the Congress leaders in TN have been in touch with the party. The Congress will be happy to have Jayalalithaa look away from a few Congress seats in Tamil Nadu.Thirdly, this case has cost the state of Karnataka several crore rupees over the years, and takes significant amount of administrative capital. The government might have to find another prosecutor if Acharya does not continue. With impending political pressure, there are not many takers.
