Just after last year’s Madras High Court ruling that any unmarried couple who “indulge in sexual gratification” will be considered a valid marriage, the HC bench in Madurai have made another judgement regarding pre-marital potency tests.The HC has recommended that the Centre bring in a legislation making pre-marital clinical examination of prospective couples cumpulsory to avoid chances of impotency or other diseases spoiling the marriage.Justice N. Kirubakaran made the suggestion in relation to a petition filed by a man against his wife for filing case stating that their marriage was null and void because of the his impotency, said a Deccan Chronicle report. Highlighting the increasing rates of impotency-effected divorces, the judge asked both central and state governments if they would amend marriage laws and reduce matrimonial disputes, according to a Times of India report. One of the questions he asked was "whether both Central and state governments are aware that failure of marriage due to impotency/frigidity of the spouse has multiplied?" said DC.
