Act prohibiting child marriage not against Muslim personal law: Madras High Court

The News Minute | April 2, 2015 | 01:53 pm IST The Madras High Court recently held that the act prohibiting child marriage is not against the Muslim personal law and that the it prevails over the personal law, states a report by PTI. "The Prohibition of Child Marriages Act is not against Muslim personal law. The act enacted for the welfare of the girl children prevails over the personal law. The former helps the girls get education, empowerment etc," the report quotes what a division bench of Justices S. Tamilvanan and V.S. Ravi said in its order on Wednesday. The court passed the order while hearing to a PIL which sought directions to officials to not interfere in the marriages performed under the personal law which according to the petitioner allows marriage of Muslim girls between the ages of 15 and 18. The court dismissed the PIL, adds the report.
