The News Minute| March 24, 2015| 11.10 am ISTThe Supreme Court of India has ruled on a clutch of nine petitions that will change the concept of internet freedom for Indians.In addition to striking down Sec 66A of the IT Act on Tuesday, the country’s apex court has called it “unconstitutional”. This landmark judgement has been much awaited in a country where the growth of the internet is expected to move on by leaps and bounds.Aside from striking down Sec 66A in its entirety, the highest court in the country has also ruled on other sections of the Information and Technology Act.Section 69A - UpheldThis act involves the power for government to block any content.The rule which, was notified in 2009, allowed the government to block any website or internet service. The government can block any content, if it is convinced it has a valid reason, then it must follow the blocking procedure, where a request has been made, as set out in the Blocking Rules. Law & procedureSection 79 (3) - Read Down Section 19 (2) - Read IntoIf a litigant believes that an intermediary, such as YouTube or Facebook, is not actively censoring material or is hosting content that should be taken down, the litigant has to seek a court approval. The content can only be removed by the intermediary once there is a court or government order.Before this, the intermediary had no opportunity to be heard if a private party demands that some content should be taken down.Meanwhile, Section 19(2) of the constitution, which allows the state to place “reasonable restrictions” on freedom of speech, has been included.
