Haryana independent RS candidate to file FIR against Subhash Chandra, others

Following his defeat in the Rajya Sabha elections from Haryana, independent candidate RK Anand said on Wednesday that he would file an FIR against the ‘criminal plot’ to defeat him.  

In an interview with The Indian Express, Anand claimed that Section 420 IPC was applicable as introduction of the ‘wrong pen’ was ‘cheating’. He also said that this was also violation of Representation of the People Act. The veteran lawyer was supported officially by the Congress and INLD.

Anand added that this incident was a ‘fraud’ on democracy and a ‘subversion of the election process’.

This comes after he lodged a complaint with the election commission against BJP MLA Aseem Goel, independent MLA Jai Prakash and Rajya Sabha member Subhash Chandra.

In his complaint, the senior lawyer had said, “It’s a clear case of fraud played on the election commission and on Congress voters to mislead them to mark their ballot without knowing as to which is the original pen.”

It was widely reported that Anand was likely to win one of the two seats from the state in the elections held on June 11 after the Congress decided to vote for him.

In a surprising development, BJP-backed media baron Subhash Chandra emerged victorious instead of Anand after 14 votes in favour of Anand by Congress MLAs were rejected on grounds of technicality of ink used in the ballot paper.
