The News Minute | January 13, 2015 | 09:30 am IST The trademark 'Nandini' legally belongs to the Karnataka Cooperative-Milk Producers’ Federation Ltd (KMF) and not to a popular restaurant chain, the Karnataka High Court said while disposing the last of the writ petitions filed by M/s Nandhini Deluxe, states a report by Bangalore Mirror. The ownership of the brand name 'Nandini' was thus ordered to belong to KMF and not Nandhini Deluxe.A division bench of the High Court of Karnataka observed that 'since related cases had been disposed of by a co-ordinate bench of the HC a month earlier in favour of KMF, there was no need for this last batch of petitions and dismissed it.'The Intellectual Property Appellate Board (IPAB) had earlier held that KMF was in "regular and consistent use of the mark 'Nandini' and it had become entrenched in the minds of the consumers and it would not be in the interest of the public to allow the restaurant chain to use the mark."According to the report, the KMF is now planning to issue a notice to the restaurant chain asking them to stop using the trademark name. The restaurant and hotel chain, which has 12 restaurants in the city including six attached to hotels, came into existence in 1989.
