Judges cannot issue non-bailable warrant without citing reasons: Karnataka High Court

The News Minute | December 23, 2014 | 10.31 pm ISTThe Karnataka High Court on Monday ruled that a magistrate or sessions court judge cannot issue non-bailable warrants (NBW) without citing specific reasons for doing so, reported the Times of India.Justice Venugopal who was hearing a petition to quash NBWs against 55 persons said, "It is incumbent for the magistrate or the sessions judge to satisfy himself whether non-bailable warrant should be issued on account of compelling circumstances."The judge, in the report, also said that 'there is no obligation on the part of an accused to appear before the court if there is no violation of bail conditions.'
