“Chandrabose died due to internal bleeding after an accident and it was a not premeditated murder', this was the defense that Beedi tycoon Mohammed Nisham charged with murder of a security guard presented before the district sessions court during a preliminary hearing of the case on Tuesday.Advocate Raman Pillai who appeared on behalf of Nisham wanted his client to be only charged under IPC 304, culpable homicide not amounting to murder. Nisham has been charged with IPC 302 for the murder of Chandrabose, a security guard at a posh apartment in Thrissur in January this year. Nisham had allegedly mowed down Chandrabose with his Hummer when the security guard failed to open the gate promptly.“Defense has submitted a petition in the court to charge only IPC 304 against Nisham and court will consider the petition on 27 July,” said Peramangalam Circle Inspector Bijukumar, the investigating officer in the case.A report says, “Defense was trying to tell the court that Nisham got out of his vehicle to help Chandrabose who was accidentally knocked down by his car.”The court then asked the defense to submit its evidence in writing and informed that the trial would begin once the prosecution submits a reply to points raised by defense.Many irregularities were reported in the primary investigation of the case with allegations that former Kerala Director General of Police (DGP) (Law and Order) K S Balasubramaniam and eight other officers including former Thrissur Police Commissioner Jacob Job were influencing the investigation.Several officers who were in-charge of the investigation had been suspended on grounds of favoritism.The charge sheet was submitted within 65 days of Nisham's arrest, following much speculation that the police was trying to save the businessman. The charge sheet, running into 500 pages with statements of 108 people, including 11 eye witnesses also contains 32 pieces of scientific evidence apart from 122 documents.
