The hearing by a three judge bench over a petition demanding the removal of Bhavani Singh as Special Public Prosecutor in AIADMK Chief J Jayalalithaa’s disproportionate assets case has been fixed for April 21.The announcement came a day after a two judge bench of the court had contrasting opinions on whether Singh should continue as the SPP, reported PTI.The matter was referred to a Chief Justice HL Dattu to constitute a larger bench to make a decision on the issue. While Justice MB Lokur strongly observed that the continuance of Singh as SPP in the disprotopitaionte assets case was a sysymbol of “failure of criminal justice delivery system.Read SC’s indecision: How will this affect Jayalalithaa’s DA case?However, the other judge on the bench, Justice Banumathi had a different opinion and held that the SPP was authorised to represent the state in the Karnataka High Court.However, considering that there has been no direct order from the Supreme Court on a stay in the Karnataka High Court pronouncing its verdict, some senior judges believed that it was free to pass orders on the appeals filed by Jayalalithaa and the other three accused in the case, reported Times of India.
