In the case hearing of a British national who took a boy to Delhi on false promises of better education in 2011 and abused him, the Madras High Court suggested that the Central government must consider castration as a form of punishment for child sex abusers.

Justice N. Kirubakaran said in the order, “When traditional laws are ineffective and incapable of addressing the menace, this court cannot keep its hands folded and remain a silent spectator, unmoved and oblivious of the recent happenings of horrible blood-curdling gang rapes of children in various parts of India.”

He added that it looks barbaric, but barbaric crimes should definitely attract barbaric model of punishment.

Talking about the reaction of activists to such acts, he said that they should support the victims and sympathise with them instead of calling it a ‘human rights violation’.

Taking into consideration the number of child sexual abuse cases involving foreigners, the judge referred it to the International Child Protection Certificate (ICPC) of United Kingdom to protect children and said that the visa needs to have a column which takes note of the impending cases.

In this case, the British national had taken a 15-year-old boy to Delhi promising him better education in 2011 and eventually abused the child and tried to have sexual intercourse with him. The victim filed a case with the help of Justice and Care Organization.

The conviction rate in cases of sexual offences against children is 2.4% and between 2008 and 2014, crimes against children had increased by 400%.

Justice N Kirubakaran’s order in 2014 suggesting mandatory pre-marital potency tests had also created a controversy.
